Some of you may know that the Electronic Privacy Information Center or EPIC has filed a lawsuit against the the department of Homeland Insecurity and the Transportation Security Theater Administration. EPIC v. DHS.

Epic is suing the DHS over the abusing passengers with their nude kiddie porn scanners, rightly claiming that they are ineffective and intrusive.

EPIC's opening brief in the case states that the Department of Homeland Security "has initiated the most sweeping, the most invasive, and the most unaccountable suspicionless search of American travelers in history," and that such a change in policy demands that the TSA conduct a notice-and-comment rule making process

During oral argument before a the Federal court in DC, DHS says they believe they have the authority and the power to institute a mandatory strip searching of all passengers without public comment or rule making.
