Hey Underwater Photographers,

Within months we will be launching the coolest new water product in ages -- the patent pending AquaStruct(tm) shower adventure system, which makes it possible for you to reinvent your shower each time you get in. The system includes not only wicked cool plumbing bits that you can move around your shower walls in any configuration you like, but also converts the otherwise boring shower curtain and tub mat into water delivery systems.

Today, we are announcing a contest, in which we hope to identify some of the hottest wet world photography and artwork out there for use on our all-new spraying water curtains. We are looking for photography and 2D artwork the following categories:

1. Inside the tube wave
2. Coral reef
3. Sharks
4. Dolphins
5. Amazing creatures of the deep (the possibilities are limitless)
6. Tropical rainforest

What is in it for the winners?

A. The chance to have your signed photograph or artwork on display in the homes of AquaStruct(tm) users everywhere.
B. A royalty of up to Fifteen Thousand U.S. Dollars ($15,000.00) based on the sale of spraying shower curtain products bearing your signed photograph or artwork at a rate of twenty-five cents ($0.25) per shower curtain sold by AquaStruct, Inc.

What do winners give up?

* They give AquaStruct, Inc. an unconditional, irrevocable, exclusive, royalty-free (except as provided above) worldwide license to use and reproduce the winning photograph or artwork in any manner, medium or format it sees fit in its sole discretion through the year 2107.
* The owner retains ownership of the winning photograph or artwork, but may use it only for personal use and may not use, publish or reproduce it in any manner, medium or format without the prior written consent of AquaStruct, Inc.

Qualifications to enter this contest?

1. You must be the creator and own all rights, title and interest in and to any photograph or artwork you submit as part of this contest. By submitting your photograph or artwork to this contest, you represent and warrant as much and agree to indemnify AquaStruct, Inc. for any damages it may incur by reason of any misrepresentation or breach of warranty on your part.
2. The photograph or artwork must be original and not published or reproduced. If it has been published or reproduced, you must provide details of the manner, medium and format in which it has been published sufficient to enable us to determine whether there might still be any interest in proceeding.
3. You must be 18 years old or older.
4. You must be citizen or resident of the United States of America or its territories.

More contest rules -

Winners - AquaStruct, Inc. will pick the winners, if any, in its sole discretion on a rolling basis through the end of August 2007. Winners must be able to provide very high resolution copies of their winning photograph or artwork to AquaStruct, Inc. promptly upon notification of success.

Deadline - Submissions after August 30, 2007, will not be considered.

Royalties - The number of spraying shower curtains sold bearing winning photography or artwork does not include spraying shower curtains returned or for which refunds have been issued for any reason. There is no minimum royalty; hence, there is no guaranty of any royalty revenue. AquaStruct, Inc. reserves the right not to use or to stop using any winning photograph or artwork at any time for any reason in its sole discretion. There may be as few or many winning photographs or artworks per category as AquaStruct, Inc. deems fit in its sole discretion. AquaStruct, Inc. may also decide to award no winners in any category. Any royalties will be paid annually in arrears. Winners will be responsible to pay any taxes due on royalties won as a result of this contest.

Submissions - All submissions must be in electronic format, no larger than 2MB in JPG format and sent to jphipps@aquastruct.com with the word "CONTEST" in the subject line. In your submission email, please provide your full name, age, email address, postal address, website (if you have one) and telephone number. By submitting any photography or artwork to this contest you agree to these rules and agree that any questions or disputes about these rules will be settled by AquaStruct, Inc. in its sole discretion.

Public input - All submissions are subject to being put to one or more public votes via the Internet on terms, at times and in a format to be determined by AquaStruct, Inc. in its sole discretion.

Not a contract or commission agreement - Nothing in these contest rules shall be interpreted as a contract or commission agreement under which any person is engaged to create photography or artworks for AquaStruct, Inc.

Vey "interesting" product. I can just see it now, my nephew comes over for a bath and the entire house gets wet. I guess it would be a good thing to have your own dive gear before using this contraption.

Anyway, I am thinking there would be better results in a flat rate payment for the artwork. I can't see selling 60,000 of these ever happening, so how about just buying the artwork for $10,000 up front?

I think for a great piece of art that has a high probability of moving product, we might consider moving the cap up or removing the cap. Also, if we see the artwork starting to really move product, we might approach the artist to offer cash in advance to purchase the remainder of his or her rights. Or we might decide to commission the artist to create a portfolio of work for use with products. By using a license and royalty structure, while we are seeking to identify great talent that we can work with, we leave open a number of options both for ourselves and for the artists. The next time around in our contest, we might consider budgeting an upfront payment. Thank you for the suggestion.

On the messiness, water everywhere front, it is no harder to aim AquaStruct than it is to aim a handheld showerhead. While some kids cannot be trusted with a handheld showerhead, most can.
