The 4th Amendment to the United States Constitution:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."


The Bush Administration, under the auspices of the Department of Homeland Security passed regulations "authorizing Border and Customs agents to search travelers' laptops, cameras, electronic devices, books, papers, a list of websites visited, all files on your computer, including your family photos and videos, your financial information, etc., all without probably cause.

The Obama Administration has enjoined violating your civil rights by agreeing to continue the criminal policy.

"Keeping Americans safe in an increasingly digital world depends on our ability to lawfully screen materials entering the United States," according to DHS Secretary Janet Napolitano.. "The new directives announced today strike the balance between respecting the civil liberties and privacy of all travelers while ensuring DHS can take the lawful actions necessary to secure our borders." Napolitan claims.

So in other words, the government believes that violating your Constitutional Rights against unreasonable searches and seizures is necessary in the name of keeping you "safe".

Let's say you and your wife go on a vacation, and with your camera on a secluded desolate beach have some fun with each other and your camera. Do you think you are any "safer" if Customs or the Border Patrol leer and drool at your photos or videos, for months?

The American Civil Liberties Union filed suit August 26th, 2009 against the U.S. Customs and Border Protection agency Wednesday, demanding they turn over records collected from searching travelers' laptops "without suspicion of wrongdoing." The reason why the ACLU filed suit if because the government violated the Freedom of Information Act law.

"Traveling with a laptop shouldn't mean the government gets a free pass to rifle through your personal papers," Catherine Crump, staff attorney with the ACLU First Amendment Working Group, said in a release. "This sort of broad and invasive search is exactly what the Fourth Amendment's protections against unreasonable searches are designed to prevent."

Some other notable Americans and others have weighed in on this issue:

This means alleged terrorists and other criminals will just upload their photos or whatever when out of country to the Internet via WiFi, then wipe that portion of their hard drive before entering the U.S.

We all know how safe and protected we were from terrorists passing through our borders before 9/11.

And in opposition to the Constitution and Benjamin Franklin, Louis Freeh, when he was head of the FBI said this:

“The American people must be willing to give up a degree of personal privacy in exchange for safety and security”.

10 years ago I told some friends, (not documented) that the US would become more of a dictatorship, and that Russia would be more of a Democracy in the next 50 years.
This seams to be comming true!
